‘It was hell on Earth’: Terrified boy, 6, is sent by a judge to live with his father who sexually and physically abused him for seven years

A boy who was sent to live with his abusive father by a Family Court judge has opened up about his traumatic childhood. 

The boy told his mother about the abuse, who then complained to a judge, but the boy was told to stay with his father.

The victim lived with his father in New South Wales for seven years, and now aged 19, he has spoken out about the ‘hell on Earth’ he endured.

‘There were many times when he was abusing me physically and sexually of course. That was my very, very earliest memories,’ the boy, using the pseudonym James, told the ABC.

‘I walked out of the bathroom and he slammed my head into the corner of a wall for absolutely no reason. There was no reason behind it, he just wanted to let his anger out on me.’

He said he never wanted to live with his father and was constantly counting down the hours at his mother’s house until he would be back within his father’s reach.

By the time he was 12, he became suicidal after regularly running away from home and showing up at the police station with bruises and scratches. 

He begged for the police to let him live with his mother but the Family Court’s ruling was enforced.

Eventually police took out an apprehended violence order against the father on the boy’s behalf, and he was placed in a refuge. 

He said it was the hardest time because he did not have any contact with his mother. 

A further investigation then found there were three more alleged child sexual assault against the victim’s father from former partners.

James has told his harrowing story as the Australian Law Reform Commission completed a review of the family court system.

The review found the system posed an ‘unacceptable risk to children’, and that children were ‘falling into harm’ because of it.
